WTO Adopts Panel Report in EU–Indonesia Fatty Acid Anti-Dumping Dispute

The WTO Dispute Settlement Body adopted on 28 August 2026 the panel report in European Union — Anti-Dumping Measures on Imports of Fatty Acid from Indonesia (DS622).

The dispute concerned EU anti-dumping duties imposed on fatty acid imports from Indonesia and raised several issues under the WTO Anti-Dumping Agreement, including the continuation of an investigation following the withdrawal of the original complaint, calculation of normal value, currency conversion, injury determination, and an alleged unwritten EU methodology.

Indonesia succeeded on a comparatively narrow but legally significant issue. The Panel found that the European Commission failed to use the exchange rate applicable on the date of sale for certain transactions, contrary to Article 2.4.1 of the Anti-Dumping Agreement. The resulting duty therefore also exceeded the dumping margin established in accordance with the Agreement, thereby engaging Article 9.3.

At the same time, the Panel rejected a substantial number of Indonesia’s other claims, including challenges to the continuation of the investigation after the withdrawal of the complaint and to important elements of the EU’s injury determination.
